COACH CLIENT CONTRACT AGREEMENT

This financial coaching agreement (“Agreement”) is entered into by and between Optionwits, the Company, and its agents (collectively referred herein as “Coach”), and its clients.

 

Section I. Financial Coaching Services. The Coach’s mission is to help new and beginner investors understand the basic concept of stock market investing and to teach the tools that will enhance new and beginner investors' knowledge and confidence to invest independently in the stock market. The Coach will illustrate how to use stock market tools to buy and sell stocks, generate income, cash flow the stock market, increase investment returns and minimize losses in a simulated environment. Both parties understand that all discussions will be based on hypothetical scenarios for learning purposes only.

 

A. The Coach follows a 7-step process to help new and beginner investors become efficient in the stock market.

 

Step 1 Learn how to use Options to enter positions.

Step 2 Practice buying stocks using Options.

Step 3 Learn how to use Options to exit positions.

Step 4 Practice how to sell stocks using Options.

Step 5 Learn a process to choose individual stocks to determine if an investor has the temperament to perform fundamental analysis or if better off investing in Exchange-Traded Funds (ETFs).

Step 6 Learn a process to value stocks (if choosing individual stocks).

Step 7 Learn a process to read charts and trends to help determine Option strategies.

 

B. Investing is personal. The length of time to feel comfortable and confident with the process depends on individual knowledge and experience. For this reason, it is highly recommended to schedule coaching sessions as needed. Some Clients may require all seven (7) steps above, whereas an experienced Client may only require the first four (4) steps. Some may also require multiple sessions for each step.  

 

C. Both parties understand and acknowledge that results will vary depending on the Client's skills and market condition. No specific outcome is guaranteed.

 

Section II Coaching Methods. The financial coaching services to be provided by the Coach to the Client will be delivered via one-on-one sessions online (video conferencing) and/or via pre-recorded videos. Communications via phone, text message, email, social media, or other means of communication will be limited to non-financial coaching services, such as, technical support regarding the website, scheduling, cancellations, and general questions about the services provided.

 

Section III Coaching Fees. Each session is $149. Payment is required at the time of scheduling each session. Price is fixed per session and is strictly for fee for service basis only. Each session is 30 minutes to 1 hour duration (depending on the amount of information presented and the number of questions discussed). Each presentation is typically 30 minutes long with the remaining 30 minutes for questions and answers.

 

A maximum of 1 hour per session is allowed. 

 

Satisfaction Guaranteed or Your Money Back. Refund amount shall be limited to the amount paid to the Company for the service(s) provided to the Client.

 

Rescheduling. Schedule changes must be made 24 hours prior to the scheduled session to avoid penalties. Otherwise, a rescheduling fee of $75 will be imposed on the Client. Missed sessions will be considered “no-shows” and will be charged the full coaching session. 

 

Cancellations. Cancellations shall be made prior to the scheduled sessions, otherwise, they shall be considered missed sessions. To obtain 100% refund, cancellations must be made no later than 24 hours prior to the scheduled session. A cancellation fee of $75 will be imposed on the Client for cancellations made with less than 24-hour notice prior to the scheduled session.

Section IV Age Requirement. The Client must be age 18 or over to participate.

 

Section V Ethics and Standard of Conduct. The Coach reserves the right to refuse service to anyone at any time. Both parties agree to adhere to the international, national, and local Code of Ethics and Standard of Conduct. Both parties agree to be respectful and always conduct business professionally.

 

Section VI Privacy Policy. The Coach agrees to maintain the highest level of confidentiality regarding the Client’s identity, financial status and investments that may be discussed during the coaching sessions, except as otherwise agreed to or as required by law.

 

Section VII Agreement Modifications. This Agreement shall not be modified, altered or amended unless the modification, alteration or amendment is in writing and signed by both parties.

 

Section VIII Term. This Agreement remains in effect until terminated in writing and signed by both parties.

 

Section IX No Affiliations. This Agreement does not create a partnership, joint venture or other affiliation between the parties.

 

Section X Disclaimer. The information and illustrations discussed with the Client are based upon the Coach’s understanding of investing in the stock market and its experience on how the Coach applies stock market tools in its investing strategies. All content presented to the Client shall not be construed as financial advice, solicitation, or recommendation. It is the Client’s responsibility to perform due diligence to verify information and/or consult with licensed professionals before investing.

 

The Coach shall not be liable for any burden or expense, financial or otherwise, resulting from the Client’s investing decisions. The Client has the choice to apply or not apply the lessons learned from the Coach. Therefore, the Client assumes all investment and financial risks that may arise out of or in any manner directly or indirectly connected with this Agreement.

Section XI Authority. This Agreement is governed by and in accordance with the laws of the State of California.  Any disputes or legal proceedings shall be conducted and processed in San Diego, California, USA.
